PART 1: TERMS OF USE

1. Introduction

  1. These Terms of Use govern your access to and use of the YouthBank International website (the “Website”). By accessing or using the Website, you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree to these Terms, you must not use the Website.
  2. YouthBank International (“YBI”, “we”, “our”, “us”) is a registered charity in Northern Ireland (Charity Number: NIC101341), with its registered office at Community House, Citylink Business Park, 6A Albert Street, Belfast BT12 4HQ.
  3. We may revise these Terms of Use at any time by amending this page. Please check this page regularly to take notice of any changes, as they are binding on you. The date of the most recent revision will be shown at the top of this document.

2. About Your Use of the Website

  1.  YBI grants you a non-exclusive, non-transferable, revocable right to access and use the Website subject to these Terms of Use.
  2. Registering with the Website allows you to share stories, ask questions and comment on topics. All submitted content will be subject to moderation to ensure it is appropriate for all audiences, including young people.
  3. By submitting content to any part of the Website, you grant YBI a royalty-free, non-exclusive licence to reproduce, publish, and distribute that content in connection with YBI’s charitable purposes. This licence is irrevocable except as provided in clause 2.4 below.

2.4 Where content has been submitted by or on behalf of a person under the age of 18, the licence granted in clause 2.3 may be revoked by the young person, their parent, or guardian by contacting YBI at info@youthbankinternational.org. Upon receipt of such a request, YBI will take reasonable steps to remove the content from the Website within a reasonable timeframe. This right of revocation is in accordance with the principles of the UK Age Appropriate Design Code.

  1. We reserve the right, at any time and without prior notice, at our sole discretion and without liability to you, to:
    1. reject your application to be a registered user;
    2. suspend or remove you as a user of the Website;
    3. prevent you from accessing any part of the Website;
    4. delete your user account; and/or
    5. remove any content you have submitted.

3. Acceptable Use

  1. By using the Website, you agree:
    1. not to use the Website for any purpose that is unlawful, promotes illegal activity, or breaches any applicable code of conduct or third party’s rights;
    2. that you hold the copyright (or have obtained appropriate permissions) for any material you submit;
    3. that you have obtained the appropriate consents from all persons appearing in any content you submit, including specific parental/guardian consent for any content featuring children or young people under 18;
    4. not to use the Website to advertise, promote commercial services, or disseminate spam;
    5. not to post anyone’s personal details without their explicit permission;
    6. not to submit any material that could cause harm to another user’s computer or device;
    7. not to submit any material that YBI may deem to be offensive, libellous, defamatory, or inappropriate for children and young people;
    8. not to reformat or frame any part of the web pages forming part of the Website;
    9. not to create multiple profiles, impersonate any person or other users, or invade anyone’s privacy;
    10. not to submit material that may have a detrimental effect on the reputation of YBI; and
    11. not to make copies in any form of all or part of the Website content other than as reasonably required for your personal, non-commercial use.

4. Safeguarding Young People

  1. YBI is committed to the safety and wellbeing of all children and young people who interact with our Website and services. We operate in accordance with our Safeguarding Policy, which is available on request.
  2.  If you are under 18, we encourage you to use the Website with the knowledge and permission of your parent or guardian.
  3.  Any user who becomes aware of content on the Website that may pose a risk to a child or young person should report it immediately to info@youthbankinternational.org.
  4. YBI reserves the right to remove any content and/or suspend any user account where there is a safeguarding concern, without prior notice.

5. Intellectual Property and Copyright

  1.  All web content, including but not limited to text, images, audio, video, and animation placed on the Website by YBI, is the copyright of or is licensed to YBI (“YBI Material”). You may not republish, retransmit, redistribute, or otherwise make YBI Material available to any other party or in any other media without prior written authorisation.

  2. The names, images, and logos identifying YouthBank International are proprietary marks of YBI and may not be reproduced without prior written authorisation.

  4. YBI is not responsible for copyright infringements made by any third party resulting from the publication of your content on the Website.

6. Linking Policy

6.1 You do not need permission to link directly to pages hosted on the Website. However, you may not load our pages into frames on your site; our pages must load in the user’s entire browser window.

6.2 Links from the Website to other websites are provided for convenience only. By accessing linked sites, you agree to any terms imposed by those sites. YBI is not responsible for the content, accuracy, or availability of linked websites.

7. Limitation of Liability

7.1 To the extent permitted by law, YBI will not be liable (including in negligence) for any loss of profits, revenue, data, or use of data, or any direct, indirect, or consequential loss or damage arising from your access to or use of the Website or any linked website.

7.2 You agree to indemnify and hold harmless YBI, its employees, trustees, board members, and volunteers from and against any claims, liability, expenses, losses, damages, and costs (including legal costs) caused directly or indirectly by your access to or use of the Website, or any content submitted by you.

7.3 Nothing in these Terms of Use shall exclude or limit YBI’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

  1. You acknowledge that you use the Website at your own risk. We do not guarantee that the Website is secure or free from bugs or viruses.

  2. YBI is not responsible for any content originating from non-YBI sources. All content is provided on an “AS IS” basis. To the maximum extent permitted by applicable law, we disclaim all warranties and conditions, whether express, implied, or statutory, regarding the Website and its content.

10.2 YBI is an international organisation and this Website may be accessed by users located outside the United Kingdom. Where users access the Website from other jurisdictions, they are responsible for compliance with any applicable local laws. Nothing in these Terms is intended to exclude any mandatory consumer protection rights that may apply under the laws of a user’s country of residence.
